Change of Venue hearing, Thursday, 9:30am, Mammoth Courthouse.

Attorneys for the Los Angeles Department of Water and Power and for Mammoth Community Water District will square off Thursday in Mammoth Court over a Change of Venue hearing.  LADWP wants its two cases that challenge Mammoth’s water rights to be heard in Fresno County, not Mono County.

In two different cases, LA claims Mammoth has no rights to Mammoth Creek water.  The only settlement offer from LADWP insists that Mammoth Community Water District replace and pay for the water LA thinks its entitled to in Mammoth Creek.  Water District Manager Greg Norby said that’s not a possible settlement.

Norby has gone public to ask local leaders and citizens to show up at Thursday’s hearing at 9:30am in the new Mammoth Courthouse.  Mono County Superior Court Judge Stan Eller is scheduled to hear the Change of Venue motion.

Norby said these challenges, which come 50 years after Mammoth was granted the right to Mammoth Creek water, are very disruptive to the small district and very expensive.

Mammoth Creek has been described as the community’s only reliable and consistent water source which supplies more than half to three-quarters of the Town’s water.

LADWP alleges that its rights to Mammoth Creek are superior to Mammoth’s.
