The trial of Dawndee Rossy is still scheduled to proceed Monday, June 27 in Independence.

The trial started four months ago. Rossy, a former supervisor with the Inyo Department of Health and Human Services faced 137 charges with the primary charge of embezzling $1.5 million for H&HS.

Initially, appointed Judge Philip Argento was scheduled to rule on defense attorney David Evans’ motions this Friday.

But, according to District Attorney Thomas Hardy, that won’t happen. “We will start up again on Monday,” Hardy stated in an e-mail.

Argento issued draft tentative rulings on Evans’ motion to dismiss evidence and charges in late May.

According to Hardy, none of the some 500-plus pieces of evidence were not dismissed and the only charges removed related to identify-theft of victims who did not testify in court.

At that point, Evans asked for time to prepare a response; Argento gave him until June 10, then allowed another week for the DA to respond to Evans’ arguments.

According to Hardy, the trial should “recommence with either defense evidence or, if the defense chooses not to present evidence, with arguments.”
