Nearly three years after her arrest on embezzlement charges, Dawndee Rossy will go to trial this Monday at the Independence Court House.
Dawndee and Kenneth Rossy were arrested on 44 felony charges April 11, 2013 but opted to be tried separately. Dawndee Rossy, represented by David Evans, also waived her right to a jury trial. Appointed Judge Phillip Argento will hear the case.
The primary charge is embezzlement of $1.5 million from Inyo County Department of Health and Human Services where Rossy was employed.
According to District Attorney Tom Hardy, the first day of trial will primarily be organizational and pre-trial motions. The real work of trying the case will start Tuesday.
A court trial “is the same process as a jury trial,” Hardy said. “It’s a little more relaxed pace.” But the presumed innocent until proven guilty and reasonable doubt criterion are the same.
He went on to describe the case as complex. “It’s going to be a difficult trial. The evidence is detailed and tedious.”
It was supposed to be a long trial but now that its not going to jury deliberation it will hopefully be much shorter. Should be interesting. I see that many of these people in the paper that have been arrested for embezzlement seem to plead guilty and reach a plea… Read more »
Having investigated many major fraud cases during my career, its good to see this case will be heard by the court and not a jury…In my experience in complicated fraud cases most jurors can’t even balance their checkbooks, and we expect them to understand the complicated paper trail of evidence… Read more »

I can’t believe it ! FINALLY It’s time to pay the piper.
ten dollars to a donut,after the “organizational and pre-trial motions “, the actual trial will once again be postponed for God knows how long this time….and once the trial finally does get under way,if found guilty,the appeals will start,and probably delaying anytype of sentencing or restitution for years to come.
