It’s complicated. That’s the bottom line of claims now pending over the collapse of the Lake Mary Tunnel two seasons ago. tunnelakemaryrd

Mammoth Mountain Ski Area had done a lot of the repair work on the collapse which took place during the construction of the adjoining pedestrian/ bike tunnel. In fact, a bulldozer was sitting on top of the tunnel when it caved in. Now, the insurance company for Mammoth Mountain has filed a claims against the Town, the contractor on the bike path, the engineers and surveyors.

Town Manager Rob Clark said since the Mountain did a lot of the work to repair the tunnel, they are trying to find out who was responsible for the collapse. Clark said there is a three-inch thick forensic account of the collapse.

As for the division of responsibility, Clark said it’s complicated and insurance companies representing all parties will likely battle it out.

This week, the Town was served with an official summons and complaint from Mammoth Mountain’s insurance company. The complaint was filed with Mono County Superior Court. The Town’s insurance carrier, the California Joint Powers Insurance Authority, has been notified according to Town officials.
