In Mono County
Court news, the trial for Charles Damato and Ryan Baruxes has been postponed.
The two men face charges of assault with a deadly weapon and vandalism plus
hate crime enhancements after allegedly beating two victims and trashing a
vehicle across from the village in Mammoth.

At the time of
the incident in February of 2006 the Mammoth Police say that they responded to
reports of four people in a fight at a parking lot across from the village.
When Officers arrived, they found two injured people who alleged that Damato
and Baruxes had targeted them with racial slurs and beat them with cast iron
motorcycle stands.

Deputy DA Todd
Graham has said the hate crime enhancements could add 2-4 years to a possible
sentence if the two are convicted of the assault with a deadly weapon charges
in this case.

The trial was
scheduled for September 11th, but has now been postponed.

Deputy DA
Graham reports that over his objections, the court vacated the trial at the
request of the defense to consider the admission of certain evidence.

A new trial
date has not been set.
