While growers and dispensers will have to wait more than a year for the state to get marijuana business licenses figured out, the passage of Proposition 64 generated the following immediate changes, according to the California Police Chiefs Association:

  • Possession of up to one ounce of marijuana is legal for those over 21.

  • Possession of over one ounce is a misdemeanor good for a $500 fine or six months in jail

  • Intent to sell: Misdemeanor, $500 fine or six months

  • Sales to minors: Felony, three to seven years

  • Possession up to eight grams of concentrate: Legal over 21

  • Possession over 8 grams of concentrate: Misdemeanor, $500 or six months

  • Transport up to one ounce: Legal over 21

  • Transport/share over one ounce: Misdemeanor, $500 or six months

  • Share up to one ounce: Legal over 21

  • Homegrow up to six plants per residence: Legal over 21

  • Homegrow over six plants: Misdemeanor, $500 or six months

  • Smoking where tobacco is banned: $250 ticket
